Patent Registration in Indonesia: Legal Framework
Patent registration is governed by:
- Law No. 13 /2016 on Patents;
- Law No. 65 /2024, its third amendment.
According to Article 1 (1) of the 2024 Law,
“Patent is an exclusive right granted by the state to an inventor for their invention in the field of technology, for a certain period, to carry out the invention or to permit others to do so.”
Based of Article 5 of the Patents Law, to qualify for patent protection, an invention must meet these criteria ):
- Novelty (new);
- Inventive Step (not obvious);
- industrial Applicability (Can be applied in industry).
Step-by-Step Patent Application Process
As regulated in Article 25 paragraph and paragraph 2 of Law No. 65/2024, a patent is granted based on an application submitted by the applicant or their representative to the Minister in writing in the Indonesian language, accompanied by the payment of the required fees.
- Application Preparation
Submit your application in Indonesian via https://paten.dgip.go.id, including:
a. Title of the invention
b. Invention description
c. Claims
d. Abstract
e. Drawings (if necessary)
f. Power of attorney (if filed through a representative)
g. Deed of assignment (if applicant is not the inventor)
h. Microorganism deposit certificate (if applicable)
i. Disclosure of genetic resources and/or traditional knowledge (if relevant)
- Administrative Examination
Within 14 days, the Directorate General of Intellectual Property (Direktorat Jendral Kekayaan Intelektual – DJKI) will verify the completeness of documents.
- Publication and Opposition
If complete, the invention enters an 18-month waiting period, during which it is published for 6 months to allow third-party objections.
- Substantive Examination
If no objection is filed, a 30-month in-depth assessment is conducted to ensure it meets the legal requirements.
- Grant or Rejection
If approved, a patent certificate is issued within 2 months.
If rejected, the applicant can file an appeal. Further rejection can be challenged in court.
